In because it is the prohibition, and because the category it names is IDOLATERS - which 5:5 distinguishes from the People of the Scripture.

In because it states a bar in general terms, and because it is the verse that makes this a CONTESTED question rather than a settled one.

Written by the editors. Not a translation, and not a source. It is an editorial restatement of the verses in this study and carries their name because someone has to answer for it.

The Qur'an permits one thing explicitly and prohibits another explicitly, and a third verse complicates both. That is why this is a contested question.

5:5 grants the permission, and its setting matters. The verse is about what is made lawful, and it moves from food to marriage in one sentence: the food of the People of the Scripture is lawful for you AND YOUR FOOD IS LAWFUL FOR THEM - and so are their VIRTUOUS WOMEN, on payment of the marriage portion and on condition of honourable marriage rather than fornication. The food clause is reciprocal; the marriage clause, as worded, is not - it names the believing man marrying a woman of the People of the Scripture.

2:221 prohibits marriage to IDOLATERS in both directions, and its reason is comparative: a believing slave is better than an idolater though he please you. Note that the category is idolaters, which 5:5 treats as distinct from the People of the Scripture.

60:10 is the verse that unsettles the picture. Speaking of believing women who have fled, it says THEY ARE NOT LAWFUL FOR THE DISBELIEVERS, NOR ARE THE DISBELIEVERS LAWFUL FOR THEM. Whether the term there covers the People of the Scripture, and whether the verse states a general rule or addresses a particular situation of migration, is precisely the point at issue.

So the text gives: an explicit permission with a named category, an explicit prohibition with a different named category, and a general bar whose scope is disputed. It does not tell you how the categories relate.

Settling that needs the commentators and the jurists, who divided over it, and no and no work of law has cleared the rights audit.

And it offers no academic-historical reading: this study holds no such scholarship. Each of those is an absence with a named cause, not an omission.

For it is immoral. Today, those who disbelieve have despaired of your religion, so do not fear them, but fear Me. Today I have perfected your religion for you, and have completed My favor upon you, and have approved Islam as a religion for you. But whoever is compelled by hunger, with no intent of wrongdoing-God is Forgiving and Merciful.

If you are ill, or travelling, or one of you returns from the toilet, or you had contact with women, and could not find water, then use some clean sand and wipe your faces and hands with it. God does not intend to burden you, but He intends to purify you, and to complete His blessing upon you, that you may be thankful.

A believing servant is better than an idolater, even if you like him. These call to the Fire, but God calls to the Garden and to forgiveness, by His leave. He makes clear His communications to the people, that they may be mindful.

তোমরা মুশরিক নারীকে ঈমান না আনা পর্যন্ত বিবাহ করো না। মুশরিক নারী তোমাদেরকেমুগ্ধ করলেও, অবশ্যই মুমিন ক্রীতদাসী তার চেয়ে উত্তম। তেমনিভাবে ঈমান না আনা পর্যন্ত মুশরিক পুরুষদের সাথে তোমরা মুসলিম মেয়েদেরকে বিবাহ দিও না। মুশরিক পুরুষ তোমাদেরকে মুগ্ধ করলেও অবশ্যই মু’মিন ক্রীতদাস তার চেয়ে উত্তম। তারা তোমাদেরকে জাহান্নামের দিকে আহ্বান করে; অথচ আল্লাহ তোমাদেরকে নিজ ইচ্ছায় ও অনুগ্রহে জান্নাত ও ক্ষমার দিকে আহ্বান করেন। আর তিনি মানুষের জন্য তাঁর আয়াতসমূহ সুস্পষ্টভাবে বর্ণনা করেন, যাতে তারা উপদেশ গ্রহণ করতে পারে।

اور شرک کرنے والی عورتوں سے تاوقتیکہ وه ایمان نہ ﻻئیں تم نکاح نہ کرو[1] ، ایمان والی لونڈی بھی شرک کرنے والی آزاد عورت سے بہت بہتر ہے، گو تمہیں مشرکہ ہی اچھی لگتی ہو اور نہ شرک کرنے والے مردوں کے نکاح میں اپنی عورتوں کو دو جب تک کہ وه ایمان نہ ﻻئیں، ایمان والا غلام آزاد مشرک سے بہتر ہے، گو مشرک تمہیں اچھا لگے۔ یہ لوگ جہنم کی طرف بلاتے ہیں اور اللہ جنت کی طرف اور اپنی بخشش کی طرف اپنے حکم سے بلاتا ہے، وه اپنی آیتیں لوگوں کے لئے بیان فرما رہا ہے، تاکہ وه نصیحت حاصل کریں۔

And do not hold on to ties with unbelieving women, but demand what you have spent, and let them demand what they have spent. This is the rule of God; He rules among you. God is Knowing and Wise.

হে মুমিনগণ! তোমাদের কাছে মু’মিন নারীরা হিজরত করে আসলে তোমরা তাদের (ঈমানের সত্যতা) পরীক্ষা করে দেখো। আল্লাহ তো তাদের ঈমান সম্পর্কে অধিক অবগত আছেন। অতঃপর যদি তোমরা জানতে পার যে, তারা সত্তিই মু’মিন নারী, তাহলে তাদেরকে আর কাফিরদের নিকট ফেরত পাঠিও না। কারণ মু’মিন নারীগণ কাফির স্বামীদের জন্য বৈধ নয় এবং কাফিররাও তাদের জন্য বৈধ নয়। কাফির স্বামীরা (মোহর হিসেবে) যা ব্যয় করেছে, তা তাদেরকে ফিরিয়ে দাও। তোমরা তাদেরকে বিয়ে করলে তোমাদের কোন অপরাধ হবে না, যদি তোমরা তাদেরকে তাদের প্রাপ্য মোহর প্রদান করো। আর তোমরা কাফির নারীদের সাথে বৈবাহিক সম্পর্ক বজায় রেখো না, তোমরা (৫) যা ব্যয় করেছ, তা তোমরা (তাদের কাফির স্বামীদের কাছে) ফেরত চাও। আর তারা (ইসলামে দীক্ষিতা স্ত্রীদের জন্যে) যা ব্যয় করেছে, তা যেন তারা তোমাদের কাছে চেয়ে নেয়। এটা (৬)আল্লাহর বিধান। তিনি তোমাদের মাঝে ফয়সালা করেন। আর আল্লাহ সর্বজ্ঞ, প্রজ্ঞাময়।

Wenn ihr sie nun als gläubige Frauen erfasst, dann schickt sie nicht zu den Ungläubigen zurück. Weder sind sie ihnen (zur Ehe) erlaubt, noch sind sie ihnen (diesen Frauen) erlaubt. Und gebt ihnen (also diesen Männern), was sie (früher als Brautgabe) ausgegeben haben (zurück). Und es ist für euch kein Vergehen, sie zu heiraten, wenn ihr ihnen ihren Lohn (also die Brautgabe) gebt. Und haltet nicht an der Ehe mit den ungläubigen Frauen fest, und fordert, was ihr (als Brautgabe) ausgegeben habt, zurück. Auch sie sollen zurückfordern, was sie ausgegeben haben (für die gläubigen Frauen). Dies ist das Urteil Allahs; Er richtet zwischen euch. Und Allah ist allwissend und allweise.

Όταν οι πιστές γυναίκες έρχονται σ' εσάς ως μετανάστες (από τη Μάκκα προς τη Μαντίνα), να τις εξετάσετε (και να τις δοκιμάσετε για να μάθετε αν είναι πράγματι πιστές)· ο Αλλάχ γνωρίζει καλύτερα για την πίστη τους. Έπειτα, αν βεβαιωθείτε ότι είναι πραγματικά πιστές, μην τις στείλετε πίσω στους άπιστους (συζύγους). Δεν είναι νόμιμες (σύζυγοι) γι' εκείνους, ούτε εκείνοι είναι νόμιμοι (σύζυγοι) γι' αυτές. ऐ ईमान वालो! जब तुम्हारे पास ईमान वाली स्त्रियाँ हिजरत करके आएँ, तो उन्हें जाँच लिया करो। अल्लाह उनके ईमान को ज़्यादा जानने वाला है। फिर यदि वे तुम्हें ईमान वाली मालूम हों, तो उन्हें काफ़िरों की ओर वापस न करो।[6] न ये स्त्रियाँ उन (काफ़िरों) के लिए हलाल हैं और न वे (काफ़िर) इनके लिए हलाल[7] होंगे। और उन काफ़िरों ने जो खर्च किया है, वह उन्हें दे दो। तथा तुमपर कोई दोष नहीं है कि उनसे विवाह कर लो, जब उन्हें उनका महर दे दो। तथा तुम काफ़िर स्त्रियों के सतीत्व को रोक कर न रखो और जो तुमने ख़र्च किया है वह माँग लो। और वे (काफ़िर) भी माँग लें, जो उन्होंने खर्च किया है। यह अल्लाह का फैसला है। वह तुम्हारे बीच फैसला करता है। तथा अल्लाह सब कुछ जानने वाला, पूर्ण हिकमत वाला है।

اے ایمان والو! جب تمہارے پاس مومن عورتیں ہجرت کرکے آئیں تو تم ان کا امتحان لو[1] ۔ دراصل ان کے ایمان کو بخوبی جاننے واﻻ تو اللہ ہی ہے لیکن اگر وه تمہیں ایمان والیاں معلوم ہوں[2] تو اب تم انہیں کافروں کی طرف واپس نہ کرو، یہ ان کے لیے حلال نہیں اور نہ وه ان کے لیے حلال ہیں[3]، اور جو خرچ ان کافروں کا ہوا ہو وه انہیں ادا کردو[4]، ان عورتوں کو ان کے مہر دے کر ان سے نکاح کر لینے میں تم پر کوئی گناه نہیں[5] اور کافر عورتوں کی ناموس اپنے قبضہ میں نہ رکھو[6] اور جو کچھ تم نے خرچ کیا ہو[7]، مانگ لو اور جو کچھ ان کافروں نے خرچ کیا ہو[8] وه بھی مانگ لیں یہ اللہ کا فیصلہ ہے جو تمہارے درمیان کر رہا ہے[9]، اللہ تعالیٰ بڑے علم (اور) حکمت واﻻ ہے.

If any of you lack the means to marry free believing women, he may marry one of the believing maids under your control. God is well aware of your faith. You are from one another. Marry them with the permission of their guardians, and give them their recompense fairly-to be protected-neither committing adultery, nor taking secret lovers. When they are married, if they commit adultery, their punishment shall be half that of free women. That is for those among you who fear falling into decadence. But to practice self-restraint is better for you. God is Most Forgiving, Most Merciful.

আর তোমাদের মধ্যে কারো স্বাধীন ঈমানদার নারীকে বিয়ের সামর্থ্য না থাকলে, তোমরা তোমাদের অধিকারভুক্ত (ঈমানদার দাসী বিয়ে করবে। আল্লাহ তোমাদের ঈমান সম্পর্কে পুরোপুরি অবহিত। মূলত তোমরা একে অপরের সমান। কাজেই তোমরা তাদেরকে বিয়ে করবে তাদের মালিকের অনুমতিক্রমে এবং তাদেরকে তাদের মোহরানা ন্যায়সংগতভাবে দিবে। তারা হবে সচ্চরিত্রা, ব্যভিচারিণী নয় ও উপপতি গ্রহণকারিণীও নয়। অতঃপর বিবাহিতা হওয়ার পর যদি তারা ব্যভিচার করে, তবে তাদের শাস্তি স্বাধীন নারীর অর্ধেক (১৪)। উক্ত বিধান তাদের জন্যে, তোমাদের মধ্যে যারা ব্যভিচারে লিপ্ত হওয়ার আশঙ্কা করে এবং স্বাধীন নারীদেরকে বিবাহে অক্ষম। আর তোমাদের জন্যে ধৈর্যধারণ করা উত্তম। (১৫) আর আল্লাহ পরম ক্ষমাশীল, অতি দয়ালু।

Und wer von euch nicht so vermögend ist, dass er ehrbare, gläubige Frauen zu heiraten vermag, der (soll) von den gläubigen Mädchen (heiraten), die eure rechte Hand besitzt. Und Allah weiß sehr wohl über euren Glauben Bescheid; die einen von euch sind von den anderen. So heiratet sie mit der Erlaubnis ihrer Familien und gebt ihnen ihren Lohn in rechtlicher Weise, wenn sie ehrbar sind, nicht solche, die Unzucht treiben und sich Liebhaber halten! Wenn sie nun (durch die Heirat) ehrbare Frauen geworden sind und dann eine Schandtat begehen, soll ihnen (nur) die Hälfte der Strafe zukommen, die ehrbaren Frauen zukommt. Dies gilt für denjenigen von euch, der (in) Bedrängnis (zu kommen) fürchtet. Doch dass ihr Geduld übt, ist besser für euch. Und Allah ist allvergebend und barmherzig.

Εσείς (οι άνδρες και οι γυναίκες) είστε ο ένας από τον άλλο (δηλ. είστε ίσοι στη θρησκεία και στην ανθρωπότητα, γι' αυτό μην ντρέπεστε να παντρευτείτε τις πιστές δούλες). और तुममें से जो व्यक्ति ईमान वाली आज़ाद स्त्रियों से विवाह करने की क्षमता न रखे, वह तुम्हारे हाथों में आई हुई तुम्हारी ईमान वाली दासियों से विवाह कर ले। अल्लाह तुम्हारे ईमान को भली-भाँति जानता है। तुम सब परस्पर एक ही हो।[23] अतः तुम उनके मालिकों की अनुमति से उन (दासियों) से विवाह कर लो और नियमानुसार उन्हें उनका महर चुका दो। जबकि वे सतीत्व की रक्षा करने वाली हों, खुल्लम खुल्ला व्यभिचार करने वाली न हों, तथा गुप्त रूप से व्यभिचार के लिए मित्र रखने वाली न हों। फिर यदि वे विवाहित हो जाने के बाद व्यभिचार करें, तो उनपर आज़ाद स्त्रियों का आधा[24] दंड है। यह (दासियों से विवाह की अनुमति) तुममें से उसके लिए है, जिसे व्यभिचार में पड़ने का डर हो, और तुम्हारा धैर्य से काम लेना तुम्हारे लिए बेहतर है और अल्लाह अत्यंत क्षमाशील, बड़ा दयावान् है।

اور تم میں سے جس کسی کو آزاد مسلمان عورتوں سے نکاح کرنے کی پوری وسعت وطاقت نہ ہو تو وه مسلمان لونڈیوں سے جن کے تم مالک ہو (اپنا نکاح کر لے) اللہ تمہارے اعمال کو بخوبی جاننے واﻻ ہے، تم سب آپس میں ایک ہی تو ہو، اس لئے ان کے مالکوں کی اجازت سے ان سے نکاح کر لو[1] ، اور قاعده کے مطالق ان کے مہر ان کو دو، وه پاک دامن ہوں نہ کہ علانیہ بدکاری کرنے والیاں، نہ خفیہ آشنائی کرنے والیاں، پس جب یہ لونڈیاں نکاح میں آجائیں پھر اگر وه بے حیائی کا کام کریں تو انہیں آدھی سزا ہے اس سزا سے جو آزاد عورتوں کی ہے[2]۔ کنیزوں سے نکاح کا یہ حکم تم میں سے ان لوگوں کے لئے ہے جنہیں گناه اور تکلیف کا اندیشہ ہو اور تمہارا ضبط کرنا بہت بہتر ہے اور اللہ تعالیٰ بڑا بخشنے واﻻ اور بڑی رحمت واﻻ ہے۔[3]

Read across the four public-domain translations - Sale 1734, Rodwell 1861, Palmer 1880, Pickthall 1930 - of 5:5, 2:221, 60:10, 4:25, in full, and nothing else. This study consults no , no , no occasion of revelation and no biography, because none is yet available in an edition whose usage rights can be verified. Itani 2012, the fifth translation shown with these verses, was not consulted for this study.

How this set was arrived at. The verses were found by a word search of the four public-domain translations, using terms chosen by the editor and listed here as they were searched - virtuous + women + of + those + who + received + the + scripture; food + of + those + who + have + received + the + scripture; wed + not + idolatresses; marry + not + idolatresses + till + they + believe. The search was a way of finding passages, not a judgement about what they mean: that several translators chose the same English word is not evidence about the Arabic. A different choice of terms gives a different set.

Where the translations part company, named rather than resolved. How differently the translations word each verse is shown on that verse's page, and the study names the differences it turns on rather than choosing between them.
