  1. 01 5:1 The beast of cattle is made lawful unto you except that which is announced unto you, GAME BEING UNLAWFUL WHEN YE ARE ON THE PILGRIMAGE. Carried as the bare statement of the rule, given in the same verse that opens with fulfil your indentures.
  2. 02 5:2 BUT WHEN YE HAVE LEFT THE SACRED TERRITORY, THEN GO HUNTING (IF YE WILL). This is here because it closes the rule's other end: the prohibition is bounded by the state of consecration, not by the animal.
  3. 03 5:94–96 In as ONE PASSAGE because the three verses are one continuous ruling and splitting them would lose the structure: 5:94 the trial by game that comes within reach of hands and spears; 5:95 kill no game while consecrated, and the forfeit for doing it deliberately - an equivalent in domestic animals, judged by two just men, or the feeding of the poor, or the equivalent in fasting; 5:96 the fish of the sea made lawful, and hunting on land forbidden so long as you are on pilgrimage. This is one of the few places the text sets out an offence, an assessment procedure and a graded expiation in consecutive verses.

Written by the editors. Not a translation, and not a source. It is an editorial restatement of the verses in this study and carries their name because someone has to answer for it.

This is one of the most specific rulings in the book, and it is worth reading for that reason alone.

The rule: while you are in the consecrated state of pilgrimage, you do not hunt. 5:1 states it. 5:2 marks the far end of it - when you have left the sacred territory, then hunt if you wish. 5:96 states both halves in one verse: the fish of the sea is lawful to you, a provision for you and for travellers, but hunting on land is forbidden while you are consecrated.

So the prohibition attaches to a STATE, not to a species. The same animal is lawful the day before and the day after. That is unusual enough to be the point of the study.

Then 5:95 does something the text rarely does: it sets out a penalty with a procedure. Whoever kills game deliberately while consecrated pays a forfeit - an equivalent from domestic animals, and the equivalence is to be judged by TWO JUST MEN FROM AMONG YOU; or feeding the poor; or the equivalent in fasting. Three routes, and a named method for assessing the first.

And 5:94 frames the whole thing as a trial: God will try you somewhat (in the matter) of the game that comes within reach of your hands and your spears, that He may know who fears Him IN SECRET. The temptation named is the easy kill nobody would see.

What the text does not settle is where the boundaries lie - what counts as game, what counts as hunting, whether the rule reaches vermin or fishing on land. The legal literature answers all of that in detail, and none of it has cleared the rights audit here. What the verses give is a rule bounded by a state, an offence, an assessment by named human judges, and three ways to make it good.

And it offers no academic-historical reading: this study holds no such scholarship. Each of those is an absence with a named cause, not an omission.

And let not the malice of some, in that they hindered you from entering the sacred temple, provoke you to transgress, by taking revenge on them in the sacred months. Assist one another according to justice and piety, but assist not one another in injustice and malice: Therefore fear God; for God is severe in punishing

حُرِّمَتْ عَلَيْكُمُ ٱلْمَيْتَةُ وَٱلدَّمُ وَلَحْمُ ٱلْخِنزِيرِ وَمَآ أُهِلَّ لِغَيْرِ ٱللَّهِ بِهِۦ وَٱلْمُنْخَنِقَةُ وَٱلْمَوْقُوذَةُ وَٱلْمُتَرَدِّيَةُ وَٱلنَّطِيحَةُ وَمَآ أَكَلَ ٱلسَّبُعُ إِلَّا مَا ذَكَّيْتُمْ وَمَا ذُبِحَ عَلَى ٱلنُّصُبِ وَأَن تَسْتَقْسِمُوا۟ بِٱلْأَزْلَٰمِ ذَٰلِكُمْ فِسْقٌ ٱلْيَوْمَ يَئِسَ ٱلَّذِينَ كَفَرُوا۟ مِن دِينِكُمْ فَلَا تَخْشَوْهُمْ وَٱخْشَوْنِ ٱلْيَوْمَ أَكْمَلْتُ لَكُمْ دِينَكُمْ وَأَتْمَمْتُ عَلَيْكُمْ نِعْمَتِى وَرَضِيتُ لَكُمُ ٱلْإِسْلَٰمَ دِينًا فَمَنِ ٱضْطُرَّ فِى مَخْمَصَةٍ غَيْرَ مُتَجَانِفٍ لِّإِثْمٍ فَإِنَّ ٱللَّهَ غَفُورٌ رَّحِيمٌ

For it is immoral. Today, those who disbelieve have despaired of your religion, so do not fear them, but fear Me. Today I have perfected your religion for you, and have completed My favor upon you, and have approved Islam as a religion for you. হে মুমিনগণ! তোমরা আল্লাহর নিদর্শনসমূহকে, হারাম মাসকে, কুরবানির জন্য কা‘বায় পাঠানো পশু (হাদী)কে, (কুরবানির উদ্দেশ্যে) গলায় (সুতো ইত্যাদির মালা) পরানো চিহ্নবিশিষ্ট পশু এবং নিজ রবের অনুগ্রহ ও সন্তোষ লাভের আশায় পবিত্র ঘর অভিমুখী যাত্রীদেরকে অবমাননা করাকে হালাল মনে করো না। যখন তোমরা (ইহরাম থেকে) হালাল হও, তখন (চাইলে) শিকার করো। তোমাদেরকে আলমসজিদুল হারামে প্রবেশে বাধা প্রদানের কারণে কোন সম্প্রদায়ের প্রতি বিদ্বেষ যেন তোমাদেরকে কখনই সীমালঙ্ঘন করতে প্ররোচিত না করে। তোমরা সৎকর্ম ও তাকওয়ায় পরস্পরের সহযোগিতা করো। আর পাপকর্ম ও সীমালঙ্ঘনের কাজে পরস্পরকে সহযোগিতা করো না। আর (আল্লাহর আনুগত্যে অনড় থেকে ও তাঁর অবাধ্যতা থেকে দূরে থেকে) আল্লাহকে ভয় করো। নিশ্চয় আল্লাহ (তাঁর অবাধ্যদেরকে) শাস্তিদানে কঠোর।

ऐ ईमान वालो! अल्लाह की निशानियों[3] का अनादर न करो, न सम्मानित महीने[4] का, न ह़रम की क़ुर्बानी का, न पट्टे वाले जानवरों का, और न उन लोगों का जो अपने पालनहार के अनुग्रह और उसकी प्रसन्नता की खोज में सम्मानित घर (काबा) की ओर जा रहे हों। और जब एह़राम खोल दो, तो शिकार करो। और किसी गिरोह की दुश्मनी, इस कारण कि उन्होंने तुम्हें मस्जिदे-ह़राम से रोका था, तुम्हें इस बात पर न उभारे कि अत्याचार करने लगो। तथा नेकी और परहेज़गारी पर एक-दूसरे का सहयोग करो और पाप तथा अत्याचार पर एक-दूसरे की सहायता न करो। और अल्लाह से डरो। निःसंदेह अल्लाह कड़ी यातना देने वाला है।

اے ایمان والو! اللہ تعالیٰ کے شعائر کی بے حرمتی نہ کرو[1] نہ ادب والے مہینوں کی[2] نہ حرم میں قربان ہونے والے اور پٹے پہنائے گئے جانوروں کی جو کعبہ کو جا رہے ہوں[3] اور نہ ان لوگوں کی جو بیت اللہ کے قصد سے اپنے رب تعالیٰ کے فضل اور اس کی رضاجوئی کی نیت سے جا رہے ہوں[4]، ہاں جب تم احرام اتار ڈالو تو شکار کھیل سکتے ہو[5]، جن لوگوں نے تمہیں مسجد حرام سے روکا تھا ان کی دشمنی تمہیں اس بات پر آماده نہ کرے کہ تم حد سے گزر جاؤ[6]، نیکی اور پرہیزگاری میں ایک دوسرے کی امداد کرتے رہو اور گناه اور ﻇلم و زیادتی میں مدد نہ کرو[7]، اور اللہ تعالیٰ سے ڈرتے رہو، بےشک اللہ تعالیٰ سخت سزا دینے واﻻ ہے۔

For it is immoral. Today, those who disbelieve have despaired of your religion, so do not fear them, but fear Me. Today I have perfected your religion for you, and have completed My favor upon you, and have approved Islam as a religion for you. But whoever is compelled by hunger, with no intent of wrongdoing-God is Forgiving and Merciful.

Or he may atone by feeding the needy, or its equivalent in fasting, so that he may taste the consequences of his conduct. God forgives what is past. But whoever repeats, God will take revenge on him. God is Almighty, Avenger.

5:95 O besimtarë! Mos e vritni gjahun duke qenë në ihram! Kushdo nga ju që e vret gjahun me paramendim, si dënim duhet të therë si kurban në Qabe një kafshë shtëpiake të ngjashme me kafshën që ka vrarë, për të cilën gjykojnë dy njerëz të drejtë nga mesi juaj; ose duhet të ushqejë si shpagim disa të varfër; ose të agjërojë në atë masë që ta ndiejë ndëshkimin e fajit të bërë. 5:94 হে তোমরা যারা ঈমান এনেছো! আল্লাহ অবশ্যই তোমাদেরকে পরীক্ষা করবেন শিকারের এমন বস্তু দ্বারা, যা তোমাদের হাত ও বর্শা নাগাল পায়, যাতে আল্লাহ জেনে নেন কে তাঁকে না দেখেও ভয় করে। সুতরাং এরপর যে সীমালঙ্ঘন করবে(২৩) তার জন্য রয়েছে যন্ত্রণাদায়ক শাস্তি।

5:95 হে তোমরা যারা ঈমান এনেছো! ইহরামে থাকা অবস্থায় তোমরা শিকার-জন্তু হত্যা করো না এবং যে তোমাদের মধ্যে ইচ্ছাকৃতভাবে তা হত্যা করবে, তার বিনিময় হলো যা হত্যা করেছে, তার অনুরূপ গৃহপালিত পশু- যা ফয়সালা করবে তোমাদের মধ্যে দু’জন ন্যায়পরায়ণ ব্যক্তি- হাদঈরূপে কা’বায় পৌঁছতে হবে অথবা সেটার কাফফারা হবে মিসকীনকে খাবার দান করা, অথবা সমান সংখ্যক সিয়াম পালন করা(২৪), যাতে সে নিজ কর্মের শাস্তি ভোগ করে। যা গত হয়েছে, আল্লাহ তা ক্ষমা করেছেন। কেউ পুনরায় (শিকার) করলে, আল্লাহ তার থেকে প্রতিশোধ নিবেন। আর আল্লাহ মহাপরাক্রমশালী, প্রতিশোধ গ্রহণকারী।

5:96 তোমাদের জন্য সমুদ্রের শিকার ও সেখানের খাদ্য হালাল করা হয়েছে; তোমাদের ও মুসাফিরদের ভোগ্যসামগ্রী হিসেবে। তবে যতক্ষণ তোমরা ইহরাম অবস্থায় থাকো স্থলভাগের শিকার তোমাদের জন্যে হারাম করা হয়েছে । আর তোমরা আল্লাহকে ভয় করো, যাঁর কাছে তোমাদেরকে সমবেত করা হবে।

5:94 O die ihr glaubt, Allah wird euch ganz gewiss mit (etwas von) dem Jagdwild prüfen, das eure Hände und Lanzen erreichen (können), damit Allah denjenigen kenne, der Ihn im Verborgenen fürchtet. Wer nun danach eine Übertretung begeht, für den gibt es schmerzhafte Strafe.

5:95 O die ihr glaubt, tötet nicht das Jagdwild, während ihr im Ihram-Zustand seid! Und wer von euch es vorsätzlich tötet, (für den gilt es,) eine Ersatzleistung (zu zahlen), ein Gleiches, wie das, was er getötet hat, an Stück Vieh – darüber sollen zwei gerechte Personen von euch richten – (eine Ersatzleistung, die) als Opfertier die Ka'bah erreichen soll. Oder (er leistet als) eine Sühne die Speisung von Bedürftigen oder die (entsprechende) Ersatzleistung an Fasten, damit er die schlimmen Folgen seines Verhaltens koste. Allah verzeiht, was (vorher) geschehen ist. Wer aber rückfällig wird, den wird Allah der Vergeltung aussetzen. Und Allah ist allmächtig und Besitzer von Vergeltungsgewalt.

5:96 Erlaubt sind euch die Jagdtiere des Meeres und (all) das Essbare aus ihm als Nießbrauch für euch und für die Reisenden; doch verboten ist euch die Jagd auf die Landtiere, solange ihr im Ihram-Zustand seid. Und fürchtet Allah, zu Dem ihr versammelt werdet.

5:94 ऐ ईमान वालो! निश्चय अल्लाह शिकार में से किसी चीज़ के साथ तुम्हारी अवश्य परीक्षा लेगा, जिसपर तुम्हारे हाथ तथा भाले पहुँचते होंगे, ताकि अल्लाह जान ले कि कौन उससे बिन देखे डरता है। फिर जो उसके पश्चात सीमा से बढ़े, तो उसके लिए दर्दनाक यातना है।

5:95 ऐ ईमान वालो! शिकार को न मारो[63], जबकि तुम एहराम की स्थिति में हो। तथा तुममें से जो उसे जान-बूझकर मारे, तो चौपायों में से उसी जैसा बदला है जो उसने मारा है, जिसका निर्णय तुममें से दो न्यायप्रिय व्यक्ति करेंगे, जो क़ुर्बानी के रूप में काबा पहुँचने वाली है, या प्रायश्चित[64] के रूप में निर्धनों को खाना खिलाना है, या उसके बराबर रोज़े रखने हैं, ताकि वह अपने किए का कष्ट चखे। अल्लाह ने क्षमा कर दिया जो कुछ हो चुका और जो फिर करे, तो अल्लाह उससे बदला लेगा और अल्लाह सबपर प्रभुत्वशाली, बदला लेने वाला है।

5:96 तथा तुम्हारे लिए समुद्र (जल) का शिकार और उसका खाना[65] हलाल कर दिया गया, तुम्हारे तथा यात्रियों के लाभ के लिए, तथा तुमपर भूमि का शिकार हराम कर दिया गया है जब तक तुम एहराम की स्थिति में रहो, और अल्लाह (की अवज्ञा) से डरो, जिसकी ओर तुम एकत्र किए जाओगे।

5:94 Troende! Gud ska helt visst pröva er genom vilt som kommer inom räckhåll för era händer och era spjut. På så sätt gör Gud tydligt vilka som fruktar honom utan att kunna se honom. Men den som därefter överträder [förbudet] ska få ett smärtsamt straff.

5:94 اے ایمان والو! اللہ تعالیٰ قدرے شکار سے تمہارا امتحان کرے گا[1] جن تک تمہارے ہاتھ اور تمہارے نیزے پہنچ سکیں گے[2] تاکہ اللہ تعالیٰ معلوم کرلے کہ کون شخص اس سے بن دیکھے ڈرتا ہے سو جو شخص اس کے بعد حد سے نکلے گا اس کے واسطے دردناک سزا ہے۔

5:95 اے ایمان والو! (وحشی) شکار کو قتل مت کرو جب کہ تم حالت احرام میں ہو[1] ۔ اور جو شخص تم میں سے اس کو جان بوجھ کر قتل کرے گا[2] تو اس پر فدیہ واجب ہوگا جو کہ مساوی ہوگا اس جانور کے جس کو اس نے قتل کیا ہے[3] جس کا فیصلہ تم میں سے دو معتبر شخص کردیں[4] خواه وه فدیہ خاص چوپایوں میں سے ہو جو نیاز کے طور پر کعبہ تک پہنچایا جائے[5] اور خواه کفاره مساکین کو دے دیا جائے اور خواه اس کے برابر روزے رکھ لئے جائیں[6] تاکہ اپنے کئے شامت کا مزه چکھے، اللہ تعالیٰ نے گذشتہ کو معاف کردیا اور جو شخص پھر ایسی ہی حرکت کرے گا تو اللہ انتقام لے گا اور اللہ زبردست ہے انتقام لینے واﻻ۔

5:96 تمہارے لئے دریا کا شکار پکڑنا اور اس کا کھانا حلال کیا گیا ہے[1] ۔ تمہارے فائده کے واسطے اور مسافروں کے واسطے اور خشکی کا شکار پکڑنا تمہارے لئے حرام کیا گیا ہے جب تک تم حالت احرام میں رہو اور اللہ تعالیٰ سے ڈرو جس کے پاس جمع کئے جاؤ گے۔
