  3. 03 2:236–237 It is no sin for you if ye divorce women while yet ye have not touched them, nor appointed unto them a portion. Provide for them, the rich according to his means and the straitened according to his means... AND IF YE DIVORCE THEM BEFORE YE HAVE TOUCHED THEM AND YE HAVE APPOINTED UNTO THEM A PORTION, THEN PAY THE HALF OF THAT WHICH YE APPOINTED, unless they agree to forgo it, or he agreeth to forgo it in whose hand is the marriage tie. In as ONE PASSAGE because it works out the position in a marriage that ends before consummation and gives a precise fraction.
  4. 04 4:24 And those of whom ye seek content by marrying them, GIVE UNTO THEM THEIR PORTIONS AS A DUTY. And there is no sin for you in what ye do by mutual agreement AFTER THE DUTY HATH BEEN DONE. In because it calls the portion a DUTY - an obligation, not a courtesy - and makes anything further conditional on its having been discharged.   5. 05 4:19 Nor to press them that ye may take away a part of that which ye have given them. In because it forbids the indirect route - pressure rather than demand. Written by the editors. Not a translation, and not a source. It is an editorial restatement of the verses in this study and carries their name because someone has to answer for it.

Who owns it is settled by a single verse and then defended by three more.

4:4: GIVE UNTO THE WOMEN FREE GIFT OF THEIR MARRIAGE PORTIONS. The payment is made to HER. Not to her father, not to her family. And the second clause proves the ownership: BUT IF THEY, OF THEIR OWN ACCORD, REMIT UNTO YOU A PART THEREOF, then you may take it. Only the owner can waive a claim, and the verse says only she can, and only voluntarily.

4:24 calls it a DUTY - an obligation owed - rather than a gift in the ordinary sense, and makes anything else in the marriage conditional on its having been discharged.

Then three verses close the routes by which it might be recovered.

4:20 forbids taking it back on divorce, HOWEVER GREAT the sum, and calls the attempt CALUMNY AND OPEN WRONG. 4:21 gives two reasons: the marriage was consummated, and THEY HAVE TAKEN A STRONG PLEDGE FROM YOU. The marriage itself is described as a solemn covenant she holds.

4:19 forbids the indirect method - PRESSING her so that part comes back.

And 2:236-237 works out the hard case. If the marriage ends before consummation and a portion was fixed, HALF is due. If none was fixed, a provision is still owed, scaled to the man's means. Either party may forgo, and the verse adds that TO FORGO IS NEARER TO PIETY.

The Qur'an nowhere sets an amount. 4:20 says HOWEVER GREAT, which implies no ceiling. What it fixes is title, and it fixes it in her.

2:236 যদি তোমরা স্ত্রীদেরকে স্পর্শ না করে অথবা মাহর নির্ধারণ না করেই তালাক দাও, তবে তোমাদের কোনো অপরাধ নেই। কিন্তু তোমরা তাদেরকে ন্যায়ানুগ পন্থায় কিছু অর্থ-সামগ্রী দিবে। সচ্ছল ব্যক্তি দিবে তার স্বচ্ছলতা অনুযায়ী এবং অসচ্ছল ব্যক্তি দিবে তার সামর্থ্য অনুযায়ী। এটা মুহসিন সৎকর্মশীল লোকদের ওপর কর্তব্য।

2:237 আর তোমরা যদি তাদেরকে স্পর্শ করার আগে তালাক দাও; অথচ তাদের জন্য মাহর ধার্য করে থাকো, তাহলে যা তোমরা ধার্য করেছ তার অর্ধেক । তবে তারা যদি (অর্ধেক মাহর) না নিয়ে (স্বামীকে) ক্ষমা করে দেয় অথবা যার হাতে বিয়ের বন্ধন রয়েছে (৬৪) সে অনুগ্রহ করতে চায় (সেটা ভিন্ন কথা)। তবে মাফ করে দেয়াই তাকওয়ার নিকটতর। আর তোমরা নিজেদের মধ্যে অনুগ্রহের কথা ভুলে যেও না। তোমরা যা করো, নিশ্চয় আল্লাহ সে সম্পর্কে সম্যক দ্রষ্টা।

(Dies ist) eine Pflicht für die Gutes Tuenden.

2:237 और यदि तुम उन्हें इससे पहले तलाक़ दे दो कि उन्हें हाथ लगाओ, जबकि तुम उनके लिए कोई महर निर्धारित कर चुके हो, तो तुमने जो महर निर्धारित किया है उसका आधा देना अनिवार्य है, सिवाय इसके कि वे (पत्नियाँ) माफ़ कर दें, अथवा वह पुरुष माफ़ कर दे जिसके हाथ में विवाह का बंधन[157] है। और यह (बात) कि तुम माफ़ कर दो तक़वा (परहेज़गारी) के अधिक क़रीब है। और आपस में उपकार करना न भूलो। निःसंदेह अल्लाह उसे ख़ूब देखने वाला है, जो तुम कर रहे हो।

2:237 اور اگر تم عورتوں کو اس سے پہلے طلاق دے دو کہ تم نے انہیں ہاتھ لگایا ہو اور تم نے ان کا مہر بھی مقرر کردیا ہو تو مقرره مہر کا آدھا مہر دے دو، یہ اور بات ہے کہ وه خود معاف کردیں[1] یا وه شخص معاف کردے جس کے ہاتھ میں نکاح کی گره ہے[2] تمہارا معاف کردینا تقویٰ سے بہت نزدیک ہے اور آپس کی فضیلت اور بزرگی کو فراموش نہ کرو، یقیناً اللہ تعالیٰ تمہارے اعمال کو دیکھ رہا ہے۔

তাছাড়া নারীদের মধ্য থেকে অন্যের বিবাহিত সব নারীদেরকে তোমাদের জন্যে হারাম করা হয়েছে। তবে (আল্লাহর পথে জিহাদ করতে গিয়ে বন্দী করার মাধ্যমে) তোমরা যাদের মালিক হয়েছো সেসব দাসীগণ ব্যতীত। এটি তোমাদের ওপর আল্লাহর বিধান। উল্লিখিত নারীগণ ছাড়া অন্য সকল নারীকে নিজেদের অর্থ-সম্পদের (মোহরানার) বিনিময়ে বিয়ে করা তোমাদের জন্য হালাল করা হয়েছে, পবিত্র থাকার উদ্দেশ্যে (বিবাহ বহির্ভূত) অবৈধ যৌনাচারে লিপ্ত হয়ে নয়। সুতরাং তাদের মধ্যে তোমরা যাদের যৌন স্বাদ আস্বাদন করেছো, তাদেরকে তাদের নির্ধারিত মোহরানা দিয়ে দাও। আর মোহরানা নির্ধারণের পর তোমরা যদি কোন বিষয়ে (নির্ধারিত মোহরানার পরিমাণে কম-বেশি করতে) পরস্পর সম্মত হও, তাতে তোমাদের কোন দোষ নেই। নিশ্চয় আল্লাহ মহাজ্ঞানী, প্রজ্ঞাময়।

तथा उन स्त्रियों से (विवाह करना हराम है), जो दूसरों के निकाह़ में हों, सिवाय तुम्हारी दासियों[21] के। यह अल्लाह ने तुम्हारे लिए अनिवार्य कर दिया[22] है। और इनके सिवा दूसरी स्त्रियाँ तुम्हारे लिए ह़लाल कर दी गई हैं कि तुम अपना धन (महर) खर्च करके उनसे विवाह कर लो (बशर्ते कि तुम्हारा उद्देश्य) सतीत्व की रक्षा हो, अवैध तरीके से काम वासना की तृप्ति न हो। फिर उन औरतों में से जिनसे तुम लाभ उठाओ, उन्हें उनका महर अवश्य चुका दो। तथा यदि महर निर्धारित करने के बाद आपसी सहमति (से कोई कमी-बेशी) कर लो, तो तुमपर कोई गुनाह नहीं है। निःसंदेह अल्लाह सब कुछ जानने वाला, पूर्ण हिकमत वाला है।

اور (حرام کی گئیں) شوہر والی عورتیں مگر وه جو تمہاری ملکیت میں آجائیں[1] ، اللہ تعالیٰ نے یہ احکام تم پر فرض کر دیئے ہیں، اور ان عورتوں کے سوا اور عورتیں تمہارے لئے حلال کی گئیں کہ اپنے مال کے مہر سے تم ان سے نکاح کرنا چاہو برے کام سے بچنے کے لئے نہ کہ شہوت رانی کرنے کے لئے[2]، اس لئے جن سے تم فائده اٹھاؤ انہیں ان کا مقرر کیا ہوا مہر دے دو[3]، اور مہر مقرر ہو جانے کے بعد تم آپس کی رضامندی سے جو طے کرلو اس میں تم پر کوئی گناه نہیں[4]، بے شک اللہ تعالیٰ علم واﻻ حکمت واﻻ ہے۔

Talal Itani2012 If any of you lack the means to marry free believing women, he may marry one of the believing maids under your control. God is well aware of your faith. You are from one another. Marry them with the permission of their guardians, and give them their recompense fairly-to be protected-neither committing adultery, nor taking secret lovers. When they are married, if they commit adultery, their punishment shall be half that of free women. That is for those among you who fear falling into decadence. But to practice self-restraint is better for you. God is Most Forgiving, Most Merciful.

Mohammed Marmaduke William Pickthall1930 And whoso is not able to afford to marry free, believing women, let them marry from the believing maids whom your right hands possess. Allah knoweth best (concerning) your faith. Ye (proceed) one from another; so wed them by permission of their folk, and give unto them their portions in kindness, they being honest, not debauched nor of loose conduct. And if when they are honourably married they commit lewdness they shall incur the half of the punishment (prescribed) for free women (in that case). হে মুমিনগণ! জবরদস্তি করে (সম্পদের ন্যায় তোমাদের বাপ-দাদার স্ত্রীদের) নারীদের ওয়ারিশ হওয়া তোমাদের জন্য বৈধ নয়। (এমনিভাবে) তোমাদের জন্যে বৈধ নয় যে, তোমরা তাদেরকে (মোহরানার) যা দিয়েছ তা থেকে কিছু আত্মসাৎ করার উদ্দেশ্যে তাদেরকে অবরুদ্ধ করে রাখা। তবে তারা (অবাধ্যতা ও) ব্যভিচারের ন্যায় সুস্পষ্ট অশ্লীলতায় লিপ্ত হয়ে থাকলে, ভিন্ন কথা। আর তোমরা তাদের সাথে সদ্ভাবে ও সম্মানজনকভাবে জীবন যাপন করবে। তোমরা যদি তাদেরকে (স্ত্রীদেরকে) অপছন্দ করো, তবে এমন হতে পারে যে, তোমরা একটি জিনিসকে অপছন্দ করছ আর আল্লাহ তাতে প্রভূত কল্যাণ রেখেছেন।

Και να μην κρατάτε αυτές (τις συζύγους σας που θέλετε να χωρίσετε, στο γάμο εμποδίζοντάς τους να παντρευτούν άλλους) για να πάρετε μέρος της προίκας που τους έχετε δώσει, εκτός κι αν διαπράξουν φανερή αισχρή πράξη (μοιχεία) (σ' αυτήν την περίπτωση επιτρέπεται να πάρετε πίσω την προίκα). Και να ζείτε μαζί τους με τον καλύτερο τρόπο. Αν τις μισείτε, ίσως να μισείτε κάτι, που ο Αλλάχ να φέρει μέσω αυτού πολλά καλά (που δεν τα περιμένετε).

Read across the four public-domain translations - Sale 1734, Rodwell 1861, Palmer 1880, Pickthall 1930 - of 4:4, 4:20-21, 2:236-237, 4:24, 4:19, in full, and nothing else. This study consults no , no , no occasion of revelation and no biography, because none is yet available in an edition whose usage rights can be verified. Itani 2012, the fifth translation shown with these verses, was not consulted for this study.

How this set was arrived at. The verses were found by a word search of the four public-domain translations, using terms chosen by the editor and listed here as they were searched - give + unto + the + women + free + gift + of + their + marriage + portions; if + they + of + their + own + accord + remit; ye + have + given + unto + one + of + them + a + sum + of + money + take + nothing + of + it; give + unto + them + their + portions + as + a + duty. The search was a way of finding passages, not a judgement about what they mean: that several translators chose the same English word is not evidence about the Arabic. A different choice of terms gives a different set.

Verses carried by more than one study. Some passages here also serve another study. Each carries its own reason in each place, and the reason states where else it appears.

Where the translations part company, named rather than resolved. How differently the translations word each verse is shown on that verse's page, and the study names the differences it turns on rather than choosing between them.
