Written by the editors. Not a translation, and not a source. It is an editorial restatement of the verses in this study and carries their name because someone has to answer for it.

The Qur'an does not contain a verse requiring a woman's consent in so many words. What it contains is a set of provisions that assume she is a party rather than an object, and one that reads oddly against them.

4:19 is the foundational one and it abolishes the older practice directly: IT IS NOT LAWFUL FOR YOU FORCIBLY TO INHERIT THE WOMEN of your deceased kinsmen. Women had passed with an estate; the verse ends that. It also forbids pressuring a widow to give back what she was given, and then adds the clause about hating a thing in which God has placed good.

4:4 makes the marriage payment hers: GIVE UNTO THE WOMEN THEIR MARRIAGE PORTIONS as a free gift - and the only person who may waive any of it is the woman, OF HER OWN ACCORD.

2:232 is the sharpest on the point. After a divorce, the woman's relatives are told: PLACE NOT DIFFICULTIES IN THE WAY OF THEIR MARRYING THEIR HUSBANDS IF IT IS AGREED BETWEEN THEM IN KINDNESS. The agreement that matters is between the two of them; the family is instructed not to obstruct it.

33:50 records a woman offering herself in marriage, and the text notes it without disapproval.

Against these stands 4:25, which requires that bondwomen be wed BY PERMISSION OF THEIR FOLK. It is the only permission clause in the marriage material, and it concerns women who are not free.

So the text removes women from being inherited, gives them the payment, gives them the power to remit it, and forbids their families obstructing their remarriage - and never states a general consent requirement outright. The developed law of consent is fiqh, and no work of law has cleared the rights audit.

Αυτό (που σας διέταξα) το λαμβάνουν υπόψη όσοι από σας πιστεύουν στον Αλλάχ και στην Έσχατη Ημέρα. (Και το να επιστρέψουν ξανά στους συζύγους τους) αυτό είναι καλύτερο για σας και πιο αγνό, και ο Αλλάχ γνωρίζει κι εσείς δε γνωρίζετε.

وَإِذَا طَلَّقْتُمُ ٱلنِّسَآءَ فَبَلَغْنَ أَجَلَهُنَّ فَأَمْسِكُوهُنَّ بِمَعْرُوفٍ أَوْ سَرِّحُوهُنَّ بِمَعْرُوفٍ وَلَا تُمْسِكُوهُنَّ ضِرَارًا لِّتَعْتَدُوا۟ وَمَن يَفْعَلْ ذَٰلِكَ فَقَدْ ظَلَمَ نَفْسَهُۥ وَلَا تَتَّخِذُوٓا۟ ءَايَٰتِ ٱللَّهِ هُزُوًا وَٱذْكُرُوا۟ نِعْمَتَ ٱللَّهِ عَلَيْكُمْ وَمَآ أَنزَلَ عَلَيْكُم مِّنَ ٱلْكِتَٰبِ وَٱلْحِكْمَةِ يَعِظُكُم بِهِۦ وَٱتَّقُوا۟ ٱللَّهَ وَٱعْلَمُوٓا۟ أَنَّ ٱللَّهَ بِكُلِّ شَىْءٍ عَلِيمٌ

Talal Itani2012 When you divorce women, and they have reached their term, either retain them amicably, or release them amicably. But do not retain them to hurt them and commit aggression. Whoever does that has wronged himself. And do not take God's revelations for a joke. And remember God's favor to you, and that He revealed to you the Scripture and Wisdom to teach you. And fear God, and know that God is aware of everything.

Talal Itani2012 Mothers may nurse their infants for two whole years, for those who desire to complete the nursing-period. It is the duty of the father to provide for them and clothe them in a proper manner. No soul shall be burdened beyond its capacity. No mother shall be harmed on account of her child, and no father shall be harmed on account of his child. The same duty rests upon the heir. If the couple desire weaning, by mutual consent and consultation, they commit no error by doing so. You commit no error by hiring nursing-mothers, as long as you pay them fairly. And be wary of God, and know that God is Seeing of what you do.

When they are married, if they commit adultery, their punishment shall be half that of free women. That is for those among you who fear falling into decadence. But to practice self-restraint is better for you. God is Most Forgiving, Most Merciful.

আর তোমাদের মধ্যে কারো স্বাধীন ঈমানদার নারীকে বিয়ের সামর্থ্য না থাকলে, তোমরা তোমাদের অধিকারভুক্ত (ঈমানদার দাসী বিয়ে করবে। আল্লাহ তোমাদের ঈমান সম্পর্কে পুরোপুরি অবহিত। মূলত তোমরা একে অপরের সমান। কাজেই তোমরা তাদেরকে বিয়ে করবে তাদের মালিকের অনুমতিক্রমে এবং তাদেরকে তাদের মোহরানা ন্যায়সংগতভাবে দিবে। তারা হবে সচ্চরিত্রা, ব্যভিচারিণী নয় ও উপপতি গ্রহণকারিণীও নয়। অতঃপর বিবাহিতা হওয়ার পর যদি তারা ব্যভিচার করে, তবে তাদের শাস্তি স্বাধীন নারীর অর্ধেক (১৪)। উক্ত বিধান তাদের জন্যে, তোমাদের মধ্যে যারা ব্যভিচারে লিপ্ত হওয়ার আশঙ্কা করে এবং স্বাধীন নারীদেরকে বিবাহে অক্ষম। আর তোমাদের জন্যে ধৈর্যধারণ করা উত্তম। (১৫) আর আল্লাহ পরম ক্ষমাশীল, অতি দয়ালু।

Und wer von euch nicht so vermögend ist, dass er ehrbare, gläubige Frauen zu heiraten vermag, der (soll) von den gläubigen Mädchen (heiraten), die eure rechte Hand besitzt. Und Allah weiß sehr wohl über euren Glauben Bescheid; die einen von euch sind von den anderen. So heiratet sie mit der Erlaubnis ihrer Familien und gebt ihnen ihren Lohn in rechtlicher Weise, wenn sie ehrbar sind, nicht solche, die Unzucht treiben und sich Liebhaber halten! Wenn sie nun (durch die Heirat) ehrbare Frauen geworden sind und dann eine Schandtat begehen, soll ihnen (nur) die Hälfte der Strafe zukommen, die ehrbaren Frauen zukommt. Dies gilt für denjenigen von euch, der (in) Bedrängnis (zu kommen) fürchtet. Doch dass ihr Geduld übt, ist besser für euch. Und Allah ist allvergebend und barmherzig.

Εσείς (οι άνδρες και οι γυναίκες) είστε ο ένας από τον άλλο (δηλ. είστε ίσοι στη θρησκεία και στην ανθρωπότητα, γι' αυτό μην ντρέπεστε να παντρευτείτε τις πιστές δούλες). और तुममें से जो व्यक्ति ईमान वाली आज़ाद स्त्रियों से विवाह करने की क्षमता न रखे, वह तुम्हारे हाथों में आई हुई तुम्हारी ईमान वाली दासियों से विवाह कर ले। अल्लाह तुम्हारे ईमान को भली-भाँति जानता है। तुम सब परस्पर एक ही हो।[23] अतः तुम उनके मालिकों की अनुमति से उन (दासियों) से विवाह कर लो और नियमानुसार उन्हें उनका महर चुका दो। जबकि वे सतीत्व की रक्षा करने वाली हों, खुल्लम खुल्ला व्यभिचार करने वाली न हों, तथा गुप्त रूप से व्यभिचार के लिए मित्र रखने वाली न हों। फिर यदि वे विवाहित हो जाने के बाद व्यभिचार करें, तो उनपर आज़ाद स्त्रियों का आधा[24] दंड है। यह (दासियों से विवाह की अनुमति) तुममें से उसके लिए है, जिसे व्यभिचार में पड़ने का डर हो, और तुम्हारा धैर्य से काम लेना तुम्हारे लिए बेहतर है और अल्लाह अत्यंत क्षमाशील, बड़ा दयावान् है।

اور تم میں سے جس کسی کو آزاد مسلمان عورتوں سے نکاح کرنے کی پوری وسعت وطاقت نہ ہو تو وه مسلمان لونڈیوں سے جن کے تم مالک ہو (اپنا نکاح کر لے) اللہ تمہارے اعمال کو بخوبی جاننے واﻻ ہے، تم سب آپس میں ایک ہی تو ہو، اس لئے ان کے مالکوں کی اجازت سے ان سے نکاح کر لو[1] ، اور قاعده کے مطالق ان کے مہر ان کو دو، وه پاک دامن ہوں نہ کہ علانیہ بدکاری کرنے والیاں، نہ خفیہ آشنائی کرنے والیاں، پس جب یہ لونڈیاں نکاح میں آجائیں پھر اگر وه بے حیائی کا کام کریں تو انہیں آدھی سزا ہے اس سزا سے جو آزاد عورتوں کی ہے[2]۔ کنیزوں سے نکاح کا یہ حکم تم میں سے ان لوگوں کے لئے ہے جنہیں گناه اور تکلیف کا اندیشہ ہو اور تمہارا ضبط کرنا بہت بہتر ہے اور اللہ تعالیٰ بڑا بخشنے واﻻ اور بڑی رحمت واﻻ ہے۔[3]

হে নবী! আমি তোমার জন্য তোমার স্ত্রীদেরকে হালাল করেছি যাদেরকে তুমি মোহরানা দিয়েছো এবং বৈধ করেছি ফায় (২৫) হিসেবে আল্লাহ তোমাকে যা দান করেছেন, তাদের মধ্য থেকে যারা তোমার মালিকানাধীন হয়েছে তাদেরকে। আর (বিয়ের জন্য বৈধ করেছি) তোমার চাচার কন্যা, ফুফুর কন্যা, মামার কন্যা, খালার কন্যাকে, যারা তোমার সাথে হিজরত করেছে, আর কোনো মু’মিনা নারী যদি নবীর জন্য নিজেকে হেবা করে, নবী তাকে বিয়ে করতে চাইলে সেও তার জন্য বৈধ। এটা বিশেষভাবে তোমার জন্য, অন্য মু’মিনদের জন্য নয়। আমি মু’মিনদের ওপর তাদের স্ত্রীদের ও তাদের অধিকারভুক্ত দাসীদের ব্যাপারে যে বিধি বিধান নির্ধারণ করেছি, তা আমি নিশ্চয় জানি; যাতে তোমার কোনো অসুবিধা না হয়। আল্লাহ অতি ক্ষমাশীল, পরম দয়ালু।

Πράγματι, επιτρέψαμε σε σένα τις γυναίκες σου που τους έδωσες τις προίκες τους, και τις δούλες σου που σου χάρισε ο Αλλάχ (όπως τη Μαρία που την έστειλε ο Αλ-Μουκάουκις ο βασιλιάς της Αιγύπτου ως δώρο προς τον Προφήτη). [Σημ. όποιος ασπάστηκε το Ισλάμ αλλά έχει παραπάνω από τέσσερις γυναίκες, έπρεπε να κρατήσει μόνο τέσσερις και να χωρίσει τις υπόλοιπες, οι οποίες θα μπορούσαν μετά να παντρευτούν με άλλους. Όμως ο Αλλάχ επέτρεψε στον Προφήτη να έχει παραπάνω από τέσσερις συζύγους για πολλούς λόγους. ऐ नबी! निःसंदेह हमने आपके लिए आपकी वे पत्नियाँ हलाल (वैध) कर दी हैं, जिन्हें आपने उनका महर चुका दिया है, तथा वे लौंडियाँ (भी) जो आपके स्वामित्व में हैं, उन लौंडियों में से जो अल्लाह ने ग़नीमत के धन से आपको[36] प्रदान की हैं। तथा आपके चाचा की बेटियाँ, आपकी फूफियों की बेटियाँ, आपके मामा की बेटियाँ और आपकी मौसियों की बेटियाँ, जिन्होंने आपके साथ हिजरत की है। तथा वह ईमान वाली महिला भी, जो स्वयं को नबी के लिए दान कर दे, यदि नबी उससे विवाह करना चाहे। यह विशेष रूप से आपके लिए है, अन्य ईमान वालों के लिए नहीं। निश्चय ही हम जानते हैं जो कुछ हमने उनपर उनकी पत्नियों तथा उनके स्वामित्व में आई हुई दासियों के संबंध[37] में फ़र्ज़ किया है; ताकि तुमपर कोई तंगी न रहे। और अल्लाह बहुत क्षमा करने वाला, अत्यंत दयालु है।

اے نبی! ہم نے تیرے لئے تیری وه بیویاں حلال کر دی ہیں جنہوں تو ان کا مہر دے چکا ہے[1] اور وه لونڈیاں بھی جو اللہ تعالیٰ نے غنیمت میں تجھے دی ہیں[2] اور تیرے چچا کی لڑکیاں اور پھوپھیوں کی بیٹیاں اور تیرے ماموں کی بیٹیاں اور تیری خاﻻؤں کی بیٹیاں بھی جنہوں نے تیرے ساتھ ہجرت کی ہے[3]، اور وه باایمان عورت جو اپنا نفس نبی کو ہبہ کردے یہ اس صورت میں کہ خود نبی بھی اس سے نکاح کرنا چاہے[4]، یہ خاص طور پر صرف تیرے لئے ہی ہے اور مومنوں کے لئے نہیں[5]، ہم اسے بخوبی جانتے ہیں جو ہم نے ان پر ان کی بیویوں اور لونڈیوں کے بارے میں (احکام) مقرر کر رکھے ہیں[6]، یہ اس لئے کہ تجھ پر حرج واقع نہ ہو، اللہ تعالیٰ بہت بخشنے اور بڑے رحم واﻻ ہے.

Read across the four public-domain translations - Sale 1734, Rodwell 1861, Palmer 1880, Pickthall 1930 - of 4:19, 4:4, 2:232, 4:25, 33:50, in full, and nothing else. This study consults no , no , no occasion of revelation and no biography, because none is yet available in an edition whose usage rights can be verified. Itani 2012, the fifth translation shown with these verses, was not consulted for this study.

How this set was arrived at. The verses were found by a word search of the four public-domain translations, using terms chosen by the editor and listed here as they were searched - it + is + not + lawful + for + you + forcibly + to + inherit + the + women; place + not + difficulties + in + the + way + of + their + marrying + their + husbands; with + the + permission + of + their + folk; give + unto + the + women + their + marriage + portions. The search was a way of finding passages, not a judgement about what they mean: that several translators chose the same English word is not evidence about the Arabic. A different choice of terms gives a different set.

Verses carried by more than one study. Some passages here also serve another study. Each carries its own reason in each place, and the reason states where else it appears.

Where the translations part company, named rather than resolved. How differently the translations word each verse is shown on that verse's page, and the study names the differences it turns on rather than choosing between them.
