5:38 is unambiguous: for the thief, male and female, cut off their hands. This study does not soften it and does not pretend the text says something else.
What it does insist on is 5:39, which is in the same passage and is routinely dropped: BUT WHOSO REPENTETH AFTER HIS WRONGDOING AND AMENDETH, LO, GOD WILL RELENT TOWARD HIM. The penalty is stated and a route away from it is stated immediately, in the next breath. A reader shown only 5:38 has been shown half a ruling.
Three drops in this study matter more than usual. 7:124, 20:71 and 26:49 all describe cutting off hands and feet on alternate sides - and in all three the speaker is PHARAOH, threatening the magicians who believed in Moses. None of the three is rendered on this page; 20:71 is carried by the study What does the Qur'an say about magic? The text puts that punishment in a tyrant's mouth. Any search on the words alone would have brought them in as evidence about Qur'anic penalties, and they are the opposite.
12:75-79 is the one narrative of a theft accusation, and it is instructive about what the text is and is not doing. When Joseph's brothers are asked what the penalty should be, they answer from THEIR OWN law - the thief himself becomes the forfeit - and the narrator notes that this is how they requite wrongdoers. The Qur'an reports a legal custom without endorsing it.
What the text does not supply is any of the machinery: no threshold value, no definition of theft, no evidentiary rule, no account of who carries it out. All of that is fiqh, and no work of law has cleared the rights audit.

5:38 Der Dieb und die Diebin: So trennt ihnen ihre Hände ab als Vergeltung für das, was sie erworben haben, und als ein warnendes Beispiel von Allah. Und Allah ist allmächtig und allweise.
5:39 Wer aber bereut, nachdem er Unrecht getan hat, und es wieder gutmacht, so nimmt Allah seine Reue gewiss an. Wahrlich, Allah ist allvergebend und barmherzig.
5:38 Και όσο για τον κλέφτη, άνδρα ή γυναίκα, κόψε το (δεξί) χέρι του/της (από τον καρπό), ως ποινή γι' αυτό που διέπραξαν• μια ποινή ως παράδειγμα από τον Αλλάχ. Και ο Αλλάχ είναι ‘Αζείζ (Παντοδύναμος, Ανίκητος) και Χακείμ (Πάνσοφος).
5:39 Αλλά όποιος στρέφεται με αληθινή μεταμέλεια προς τον Αλλάχ μετά από την αδικία του (τη ληστεία που έκανε) και διορθώσει (τις πράξεις του), ο Αλλάχ θα δεχτεί τη μεταμέλειά του. 5:39 Lakini mwenye kutubia baada ya dhuluma yake, na akatengenea, basi Mwenyezi Mungu ataipokea toba yake. Hakika Mwenyezi Mungu ni Mwenye kufuta dhambi, Mwenye kurehemu.

As for those who disbelieve, lo! if all that is in the earth were theirs, and as much again therewith, to ransom them from the doom on the Day of Resurrection, it would not be accepted from them. Theirs will be a painful doom
Verily, those who disbelieve, even though they had what is in the earth, all of it, and the like thereof with it, to offer as a ransom from the punishment of the resurrection day, it would not be accepted from them; but for them is grievous woe
As to the infidels - if that they had twice the riches of the earth to be their ransom from torment on the day of resurrection, it should not be accepted from them! And a dolorous torment shall be their's
Moreover they who believe not, although they had whatever is in the earth, and as much more withal, that they might therewith redeem themselves from punishment on the day of resurrection; it shall not be accepted from them, but they shall suffer a painful punishment
يُرِيدُونَ أَن يَخْرُجُوا۟ مِنَ ٱلنَّارِ وَمَا هُم بِخَٰرِجِينَ مِنْهَا وَلَهُمْ عَذَابٌ مُّقِيمٌ

Do ye not know that God, His is the kingdom of the heavens and the earth; He punishes whom He pleases, and forgives whom He pleases, for God is mighty overall
Knowest thou not that the sovereignty of the Heavens and of the Earth is God's? He chastiseth whom He will, and whom He will He forgiveth. And God hath power over all things
Dost thou not know that the kingdom of heaven and earth is God's? He punisheth whom he pleaseth, and he pardoneth whom he pleaseth; for God is almighty
يَٰٓأَيُّهَا ٱلرَّسُولُ لَا يَحْزُنكَ ٱلَّذِينَ يُسَٰرِعُونَ فِى ٱلْكُفْرِ مِنَ ٱلَّذِينَ قَالُوٓا۟ ءَامَنَّا بِأَفْوَٰهِهِمْ وَلَمْ تُؤْمِن قُلُوبُهُمْ وَمِنَ ٱلَّذِينَ هَادُوا۟ سَمَّٰعُونَ لِلْكَذِبِ سَمَّٰعُونَ لِقَوْمٍ ءَاخَرِينَ لَمْ يَأْتُوكَ يُحَرِّفُونَ ٱلْكَلِمَ مِنۢ بَعْدِ مَوَاضِعِهِۦ يَقُولُونَ إِنْ أُوتِيتُمْ هَٰذَا فَخُذُوهُ وَإِن لَّمْ تُؤْتَوْهُ فَٱحْذَرُوا۟ وَمَن يُرِدِ ٱللَّهُ فِتْنَتَهُۥ فَلَن تَمْلِكَ لَهُۥ مِنَ ٱللَّهِ شَيْـًٔا أُو۟لَٰٓئِكَ ٱلَّذِينَ لَمْ يُرِدِ ٱللَّهُ أَن يُطَهِّرَ قُلُوبَهُمْ لَهُمْ فِى ٱلدُّنْيَا خِزْىٌ وَلَهُمْ فِى ٱلْـَٔاخِرَةِ عَذَابٌ عَظِيمٌ

O Messenger! Do not let those who are quick to disbelief grieve you-from among those who say with their mouths, "We believe," but their hearts do not believe; and from among the Jews-listeners to lies, listeners to other people who did not come to you. They distort words from their places, and they say, "If you are given this, accept it; but if you are not given it, beware." Whomever God has willed to divert, you have nothing for him from God. Those are they whose hearts God does not intend to purify. For them is disgrace in this world, and for them is a great punishment in the Hereafter.
O Messenger! Let not them grieve thee who vie one with another in the race to disbelief, of such as say with their mouths: "We believe," but their hearts believe not, and of the Jews: listeners for the sake of falsehood, listeners on behalf of other folk who come not unto thee, changing words from their context and saying: If this be given unto you, receive it, but if this be not given unto you, then beware! He whom Allah doometh unto sin, thou (by thine efforts) wilt avail him naught against Allah. Those are they for whom the Will of Allah is that He cleanse not their hearts. Theirs in the world will be ignominy, and in the Hereafter an awful doom

Thus We devised a plan for Joseph; he could not have detained his brother under the king's law, unless God so willed. We elevate by degrees whomever We will; and above every person of knowledge, there is one more learned.

And he began with their sacks before the sacks of his brother; then he drew it forth from his brother's sack. Thus did we devise a stratagem for Joseph. He could not take his brother by the king's religion except God pleased;- we raise the degrees of whomsoever we please, and over every possessor of knowledge is one who knows
And Joseph began with their sacks, before the sack of his brother, and then from the sack of his brother he drew it out. This stratagem did we suggest to Joseph. By the King's law he had no power to seize his brother, had not God pleased. We uplift into grades of wisdom whom we will. And there is one knowing above every one else endued with knowledge
Then he began by their sacks, before he searched the sack of his brother; and he drew out the cup from his brother's sack. Thus did we furnish Joseph with a stratagem. It was not lawful for him to take his brother for a bondman, by the law of the king of Egypt, had not God pleased to allow it, according to the offer of his brethren. We exalt to degrees of knowledge and honour whom we please: And there is one who is knowing above all those who are indued with knowledge

12:75 "Ndëshkimi për atë, në barrën e të cilit gjendet ajo (gjëja e e vjedhur) është që të mbahet rob. Kësisoj ne i dënojmë zullumqarët."
12:76 Ai filloi (kontrollimin) nga barrët e tyre para barrës së vëllait të vet (Benjaminit) e më pas e nxori atë nga barra e të vëllait. 12:79 Ai tha: "Allahu na ruajttë që të marrim dikë tjetër përveç atij tek i cili e gjetëm sendin tonë! Atëherë do të ishim njëmend të padrejtë."
12:75 তারা বললো: ‘(আমাদের নিকট) তার শাস্তি হবে, যার মালপত্রের ভিতর চুরিকৃত জিনিসটি পাওয়া যাবে, সে নিজেই হবে তার বিনিময়। (২১) এভাবেই আমি যালিমদেরকে শাস্তি দিয়ে থাকি।
12:76 তারপর সে তার (আপন) ভাইয়ের পাত্রের পূর্বে তাদের (সৎ ভাইদের) পাত্রগুলো দিয়ে তল্লাশি শুরু করলো। তারপর সেটি তার (আপন) ভাইয়ের পাত্র থেকে বের করলো। এভাবে আমি ইউসুফের জন্য কৌশল করলাম।(২২) আল্লাহর ইচ্ছা ছাড়া বাদশাহর আইনে সে তার ভাইকে রেখে দিতে পারত না। আমি যাকে ইচ্ছা তার মর্যাদা উঁচু করে দেই এবং প্রত্যেক জ্ঞানীর ওপর রয়েছে একজন মহাজ্ঞানী।
12:77 (পানপাত্রটি বিন ইয়ামিনের বস্তায় পাওয়া গেল, তখন) তারা (ইউসুফের ভাইয়েরা) বললো: ‘যদি সে চুরি করে থাকে (তাতে আশ্চর্য হওয়ার কিছুই নেই), কারণ ইতঃপূর্বে তার এক সহোদর ভাই চুরি করেছিল।’(২৩) ইউসুফ এ কথার আঘাতের কষ্টটি নিজের কাছে লুকিয়ে রাখলো, তাদের কাছে প্রকাশ করলো না, সে (মনে মনে) বললো: ‘তোমাদের অবস্থান তো (পূর্বের মতোই) নিকৃষ্টতর। আর তোমরা যা বলছো, সে সম্পর্কে আল্লাহ ভালোভাবেই অবগত রয়েছেন।’
12:78 তারা বললো: ‘হে আযীয, তার পিতা অতিশয় বৃদ্ধ। আপনি তার স্থলে আমাদের একজনকে রেখে দিন। আমরা তো আপনাকে সৎকর্মশীলদের একজন দেখছি ।
12:79 সে বললো: ‘যার কাছে আমাদের মাল পেয়েছি তাকে ছাড়া (নির্দোষ) কাউকে পাকড়াও করা হতে আল্লাহর আশ্রয় চাচ্ছি। এমন করলে আমরা নিশ্চিত যালিম হয়ে যাবো।’

12:77 Ɓe mbi'i: "Si o wujjii, haray musɗo- neene-gooto makko wujjiino ko adii". Yuusufu mari ɗum ka woŋkii makko, o feññinanaani ɓe ɗuum. o maaki: "Ko onon ɓuri bon´de nokku! Ko Alla ɓuri anndude ko cifotoɗon".
12:78 Ɓe mbi'i: "heyma yo laamɗo on, oo no mari baabiraawo nawyuɗo oggos; ƴettu gooto e amen lomto makko. Menen men nji'ii ma jeyaaɗo e moƴƴinooɓe ɓeen".
12:79 O maaki: "Moolaare Alla nde min nanngata si wanaa oon mo men tawi doŋle amen ɗeen e juuɗe mun. Mene haray ontuma ko men tooñɓe".

12:76 Da begann er (zunächst) in ihren Behältern (zu suchen) vor dem Behälter seines Bruders. Hierauf holte er es aus dem Behälter seines Bruders hervor. Auf diese Weise führten Wir für Yusuf eine List aus. Nach dem Gesetz des Königs hätte es ihm nicht zugestanden, seinen Bruder (als Sklaven) zu nehmen, außer dass Allah es wollte. 12:79 (Ο Ιωσήφ) είπε: «Αναζητούμε καταφύγιο στον Αλλάχ από το να πάρουμε κάποιον άλλον εκτός απ' εκείνο που βρήκαμε τα πράγματά μας μαζί του, γιατί (αν θα κάναμε κάτι τέτοιο) τότε θα ήμασταν άδικοι.»
12:75 उन्होंने कहा : उसका दंड यह है कि जिसके सामान में वह पाया जाए, वही व्यक्ति उसका दंड है। हम अत्याचारियों को इसी प्रकार दंड देते हैं।[24]
12:76 चुनाँचे उसने अपने (सगे) भाई के थैले से पहले, उनके थैलों की तलाशी शुरू की। फिर उसे अपने भाई के थैले से निकाला। इस प्रकार, हमने यूसुफ़ के लिए उपाय किया।[25] वह राजा के नियम के अनुसार अपने भाई को नहीं रख सकते थे, परंतु यह कि अल्लाह चाहे। हम जिसके चाहते हैं, पद ऊँचे कर देते हैं और प्रत्येक ज्ञानवान से ऊपर एक बड़ा ज्ञानवान है।[26]

12:78 उन्होंने कहा : ऐ अज़ीज़![27] इसका एक बहुत बूढ़ा पिता है। इसलिए आप हममें से किसी को इसके स्थान पर रख लीजिए। निःसंदेह हम आपको उपकारी देखते हैं।
12:79 यूसुफ़ ने कहा : अल्लाह की शरण चाहते हैं कि हम उसके अतिरिक्त किसी को पकड़ें, जिसके पास हमने अपना सामान पाया है! निश्चय उस समय तो हम अत्याचारी ठहरेंगे।

12:78 Dissero: «O signore, in verità lui ha un padre molto vecchio. Prendi al suo posto uno di noi. In verità ti vediamo tra i pii!»
12:79 Disse: «Allāh non voglia che non prendiamo proprio quello che aveva la nostra roba: in quel caso saremmo in verità` ingiusti!»

12:77 Isaan (obboleeyyan Yuusuf) ni jedhan: “Yoo hates, (waan haarawaa miti) obboleessi isaas (Yuusufis) kana dura hatee ture.” Yuusuf ishee lubbuu isaa keessatti dhokse, Isaaniif ishee hin ibsine (Of keessattis) ni jedhe: “Isinumatu sadarkaan keessan gadheedha. Rabbiin waan isin jettan (kijibdan) beekaadha.”
12:78 Isaanis ni jedhan: “Yaa mootichaa! isaaf abbaa jaarsa manguddoo ta’etu (kan haalaan isa jaalatu) jira. Kanaaf bakka isaa tokkoon keenya fudhadhu. Nuti gaggaarii irraa ta’uu kee si argina.”
12:79 (yuusuf) ni jedhe: “Nuti nama meeshaa keenya isa biratti argine malee (nama qulqulluu) fudhachuu irraa Rabbitti maganfanna. nuti yeroo san miidhaa hojjattoota.”

12:79 Он сказал: «Упаси Аллах взять кого-либо, кроме того, у кого мы нашли нашу вещь! Воистину, тогда мы были бы несправедливы».
12:75 „Казна за оног у чијем се товару то нађе – јесте сам он“, одговорише браћа. „Ето тако ми кажњавамо насилнике.“

12:79 Akasema: Mwenyezi Mungu apishe mbali kumshika yeyote yule isipokuwa yule tuliyemkuta naye kitu chetu. Hakika, hapo tutakuwa ni wenye kudhulumu.

Çünkü hükümdarın kanunlarına göre kardeşini alıkoyamazdı. Ancak Allah'ın dilemesi başka. Dilediğimizi derecelerle yükseltiriz. Her ilim sahibinden üstün bir bilen bulunur.
12:77 Dediler ki: “Eğer o çalmış bulunuyorsa, daha önce onun bir kardeşi de çalmıştı.” Yûsuf, bu (sözleri) içinde gizledi ve onlara belli etmedi. İçinden, “Siz kötü bir durumdasınız; anlattığınızı Allah çok daha iyi biliyor.” dedi.
12:78 Onlar, Yûsuf ’a: “Ey Aziz! Onun çok yaşlı bir babası var. Onun yerine bizden birini alıkoy. Şüphesiz biz senin iyilik edenlerden olduğunu görüyoruz.” dediler.
12:79 Yûsuf : “Malımızı yanında bulduğumuz kimseden başkasını tutmaktan Allah’a sığınırız. Şüphesiz biz o takdirde zulmetmiş oluruz.” dedi.
12:75 جواب دیا کہ اس کی سزا یہی ہے کہ جس کے اسباب میں سے پایا جائے وہی اس کا بدلہ ہے[1] ۔ ہم تو ایسے ﻇالموں کو یہی سزا دیا کرتے ہیں.[2]
12:76 پس یوسف نے ان کے سامان کی تلاشی شروع کی، اپنے بھائی کے سامان کی تلاشی سے پہلے، پھر اس پیمانہ کو اپنے بھائی کے سامان (زنبیل) سے نکالا[1] ۔ ہم نے یوسف کے لئے اسی طرح یہ تدبیر کی[2]۔ اس بادشاه کے قانون کی رو سے یہ اپنے بھائی کو نہ لے سکتا تھا[3] مگر یہ کہ اللہ کو منظور ہو۔ ہم جس کے چاہیں درجے بلند کر دیں[4]، ہر ذی علم پر فوقیت رکھنے واﻻ دوسرا ذی علم موجود ہے.[5]
12:77 انہوں نے کہا کہ اگر اس نے چوری کی (تو کوئی تعجب کی بات نہیں) اس کابھائی بھی پہلے چوری کر چکا ہے[1] ۔ یوسف (علیہ السلام) نے اس بات کو اپنے دل میں رکھ لیا اور ان کے سامنے بالکل ﻇاہر نہ کیا۔ کہا کہ تم بدتر جگہ میں ہو[2]، اور جو تم بیان کرتے ہو اسے اللہ ہی خوب جانتا ہے.
12:78 انہوں نے کہا کہ اے عزیز مصر[1] ! اس کے والد بہت بڑی عمر کے بالکل بوڑھے شخص ہیں۔ آپ اس کے بدلے ہم میں سے کسی کو لے لیجئے۔ ہم دیکھتے ہیں کہ آپ بڑے نیک نفس ہیں.[2]
12:79 یوسف (علیہ السلام) نے کہا ہم نے جس کے پاس اپنی چیز پائی ہے اس کے سوا دوسرے کی گرفتاری کرنے سے اللہ کی پناه چاہتے ہیں، ایسا کرنے سے تو ہم یقیناً ناانصافی کرنے والے ہو جائیں گے.[1]

They said, 'By God! Ye knew we came not to do evil in the land, and that we were not thieves
They said, "By God! ye know certainly that we came not to do wrong in the land and we have not been thieves
Joseph's brethren replied, by God, ye do well know, that we come not to act corruptly in the land, neither are we thieves

And when they despaired of him, they conferred privately. Their eldest said, "Don't you know that your father received a pledge from you before God, and in the past you failed with regard to Joseph? I will not leave this land until my father permits me, or God decides for me; for He is the Best of Deciders."
So, When they despaired of (moving) him, they conferred together apart. The eldest of them said: Know ye not how your father took an undertaking from you in Allah's name and how ye failed in the case of Joseph aforetime? Therefore I shall not go forth from the land until my father giveth leave or Allah judgeth for me. He is the Best of Judges
And when they despaired of him they retired to consult privately. Said the eldest of them, 'Do ye not know that your father has taken a compact from God against you? Aforetime ye exceeded in the matter of Joseph - I will surely not quit the land until my father give me leave, or God judge for me, for He is the best of judges
And when they despaired of Benjamin, they went apart for counsel. The eldest of them said, "Know ye not how that your father hath taken a pledge from you before God, and how formerly ye failed in duty with regard to Joseph? I will not quit the land till my father give me leave, or God decide for me; for of those who decide is He the best
And when they despaired of obtaining Benjamin, they retired to confer privately together. And the elder of them said, do ye not know that your father hath received a solemn promise from you, in the name of God; and how perfidiously ye behaved heretofore towards Joseph? Wherefore I will by no means depart the land of Egypt, until my father give me leave to return unto him, or God maketh known his will to me; for he is the best judge
ٱرْجِعُوٓا۟ إِلَىٰٓ أَبِيكُمْ فَقُولُوا۟ يَٰٓأَبَانَآ إِنَّ ٱبْنَكَ سَرَقَ وَمَا شَهِدْنَآ إِلَّا بِمَا عَلِمْنَا وَمَا كُنَّا لِلْغَيْبِ حَٰفِظِينَ

Return unto your father and say: O our father! Lo! thy son hath stolen. We testify only to that which we know; we are not guardians of the Unseen
Return ye to your father and say, "O our father! verily, thy son has committed theft, and we bore testimony to naught but what we knew; for of the unforeseen we were not keepers
Return ye to your father and say, 'O our father! Verily, thy son hath stolen: we bear witness only of what we know: we could not guard against the unforeseen

Sie sagten: „Bei Allah, ihr wisst doch, wir sind nicht gekommen, um im Land Unheil zu stiften, und wir sind keine Diebe.“
Είπαν: «Μα τον Αλλάχ! Ξέρετε καλά ότι δεν ήρθαμε για να σκορπίσουμε το κακό στη γη, ούτε είμαστε κλέφτες.»
उन्होंने कहा : अल्लाह की क़सम! निश्चय तुम जान चुके हो कि हम इस देश में बिगाड़ पैदा करने नहीं आए हैं और न हम कभी चोर थे।
Dissero: «Per Allāh! Voi sapete che non siamo venuti sulla terra a portare corruzione e non siamo dei ladri.»

Isaanis ni jedhan: “Rabbitti kakannee! Akka nuti dachii keessatti badii raawwachuuf hin dhufin isinis beektanii jirtu, Nuti hattoota hin taane.”

Read across the four public-domain translations - Sale 1734, Rodwell 1861, Palmer 1880, Pickthall 1930 - of 5:38-39, 12:75-79, 12:73, in full, and nothing else. This study consults no , no , no occasion of revelation and no biography, because none is yet available in an edition whose usage rights can be verified. Itani 2012, the fifth translation shown with these verses, was not consulted for this study.
How this set was arrived at. The verses were found by a word search of the four public-domain translations, using terms chosen by the editor and listed here as they were searched - thief + cut; male + thief + female + thief; cut + off + hands; steal; stole. The search was a way of finding passages, not a judgement about what they mean: that several translators chose the same English word is not evidence about the Arabic. A different choice of terms gives a different set.
What was returned and not carried. 5 verse(s) the search qualified are recorded as not carried with a reason each, rather than silently discarded: 5:33 - the hiraba verse - a different offence, not answered here; 7:124 - PHARAOH'S threat to the magicians - a tyrant's punishment, not a divine prescription. A single-word search would have filed it as evidence about theft; 20:71 - the same; 26:49 - the same; 60:12 - the women's pledge; theft is named in a list of undertakings.
